An escrow assistant moves the transaction while the escrow officer holds the authority. The assistant opens files, orders and chases third-party items, prepares drafts for review, coordinates signings, answers the parties, and archives the file. The officer gives instructions, interprets the contract, and releases money.
That boundary is the whole job description. Write it down and the role works. Leave it vague and you get an assistant who either waits for permission on everything or quietly starts making calls that belong to a licensed officer, and both failures surface in month three rather than week one.

Write the Escalation Line Before the Duties List
The most useful sentence in an escrow assistant posting is not a duty at all. Licensing is a state question, not a national one
There is no national escrow license. Some states license the escrow company and its officers directly: California licenses independent escrow agents through its Department of Financial Protection and Innovation under the Escrow Law, Washington registers escrow agents and requires escrow officers to pass a state examination under its Escrow Agent Registration Act, and Texas licenses escrow officers through its Department of Insurance. Other states regulate escrow only through title insurance rules, and in attorney closing states the work happens inside a law firm under attorney supervision. Assistants are usually not the licensed party, but the acts they may perform are limited by whatever the licensed party is permitted to delegate. Write the boundary into the job description and confirm it with your state regulator before you post.
Bonding and fingerprints come before the first file
Because this role touches other people's money, several states attach personal clearance requirements to individual employees rather than to the company alone. Washington requires escrow agents to carry a fidelity bond of at least one million dollars in the aggregate covering each officer, partner, escrow officer, and employee engaged in escrow transactions, with a maximum deductible of ten thousand dollars. California requires licensed independent escrow companies to belong to the Escrow Agents' Fidelity Corporation, whose certificate program collects fingerprints and criminal history through the state Department of Justice, and requires agents to file fingerprint information on new employees within ten days of hire. Texas requires most escrow officer applicants to complete a fingerprint background check. Build the clearance into the offer, not into the first month.
Trust accounting duties belong in the job description
Escrow funds are not company funds. They cannot be commingled with operating money, and the standard control is a three-way reconciliation that ties the bank balance, the book balance, and the sum of individual file ledgers to the same number on a set schedule. Write into the posting who prepares a disbursement, who approves it, and who reconciles, and make sure those are not all the same person. Segregation of duties is the single cheapest fraud control a small escrow operation has, and it only works if it is a documented expectation rather than an assumption. State trust accounting and record retention rules vary, and your title underwriter may impose stricter ones through your agency agreement. Read both before you write the duties list.
