Search for a dean of students job description and you get two things that will not help you: a public district posting written against a negotiated contract, and a university student affairs description written for a campus with dormitories and a federal reporting office. If you run an independent school or a charter school, neither describes the job you are about to fill.
The gap matters because this is the hire small schools get wrong most often. A dean of students is the person who takes the call when a family is furious, decides whether a suspension is warranted, and writes the record that will be reread months later. Hire loosely and you get someone with responsibility for discipline and no stated authority to exercise it.

What a Dean of Students Actually Owns
A dean of students owns student conduct, culture, attendance, and family communication, and reports to the head of school or principal. The role exists so the person running the whole school is not spending every afternoon on behavior referrals. That is the honest reason it gets created, and it should shape how you write the posting.

Write the Authority, Not Only the Duties
The difference between a dean who lasts and a dean who leaves in year two is almost always the authority line. Before you post, decide four things and put them in writing: what the dean can decide alone, what requires the head of school, what goes to a committee or honor council, and what a family can appeal and to whom. Then make sure the same language appears in the family handbook. A dean whose decisions are routinely reversed above them stops making decisions, and at that point you have paid for a role that no longer functions.
Which Kind of School Is Hiring Changes the Job
The same title means four different jobs depending on the employer. An independent school dean works from a handbook and an enrollment contract. A charter school dean works from statute, an authorizer, and federal obligations that come with public school status. The other two settings on this page are not our reader.
Charter schools are a meaningful slice of the small employer market. The National Center for Education Statistics reports roughly 7,800 public charter schools enrolling 3.7 million students in the 2021 to 2022 school year, about eight percent of public schools. Private K-12 is larger still: 29,730 schools serving about 4.7 million students in the same year, per the federal Private School Universe Survey.

You write the rules
Conduct policy, discipline process, records retention, and the dean’s authority all come from your handbook and your enrollment contract rather than from statute. Nobody hands you a job description, and nobody reviews it either.
Charter school
Public obligations, small staff
A charter is a public school with an authorizer, federal civil rights obligations, and special education procedures around removals, but it is often staffed like a small business. The dean carries both realities.

Overtime and the Academic Administrative Exemption
A dean of students is usually exempt, but under a different rule than a teacher. The relevant category is academic administrative personnel: employees whose primary duty is performing administrative functions directly related to academic instruction or training in an educational establishment.
That exemption carries a compensation rule you will not find anywhere else in the regulations. The salary requirement under the rule on educational establishments is met either at the standard federal weekly salary level of $684 per week, which the Department of Labor restored after the 2024 rule was vacated in court and formally rescinded in May 2026, or by a salary at least equal to the entrance salary for teachers at the school employing the person. Schools are covered enterprises under the Fair Labor Standards Act regardless of revenue.
The academic administrative exemption has a second salary path
Most exempt roles have to clear one weekly salary floor. Academic administrative employees have two options: the standard federal weekly salary level, or a salary at least equal to the entrance salary for teachers at the school that employs them. That second path exists because school administrators are often paid on the teacher scale plus a stipend, and it can make a dean exempt at a salary that would not clear the floor in another industry. The primary duty test still has to be met: administrative functions directly related to academic instruction, performed in an educational establishment. The regulation names principals and vice-principals and academic counselors as examples, and it expressly excludes building management and maintenance jobs, jobs relating to student health, and staff such as social workers, psychologists, and dietitians. Charter and independent are not the same employer
A charter school is a public school. Federal civil rights obligations, special education protections, and the federal student records law that applies to schools receiving Department of Education funds generally reach it, and an authorizer sits above it asking for data. An independent school that takes no such federal funding is generally outside that student records law, which surprises new deans who arrive from a district and assume the same rules follow them. What replaces it is your own policy and your enrollment contract, which means the promises in your handbook and your marketing are the enforceable standard. Neither setting is looser than the other in practice. One is governed by statute and an authorizer, the other by contract and reputation, and the dean is the person who has to know which one they are working in before making the first suspension decision.
