That ambiguity costs a small company more than it costs a large one. When marketing is a team of two, the first hire either compounds or consumes the second person's week, and a vague job description is how you end up with the second outcome. Exempt or Non-Exempt: Decide Before You Post

Assume this role is non-exempt unless the duties clearly prove otherwise. The administrative exemption requires all three of its tests to pass at once, and marketing teams routinely satisfy two and declare the matter settled.

The administrative exemption has three parts, and marketing teams tend to stop after the second one. The employee must be paid on a salary basis, at or above the federal threshold of $684 per week ($35,568 per year). Their primary duty must be office work directly related to management or general business operations, and the Department of Labor lists advertising and marketing among the qualifying functional areas, which is where people declare victory. The third part is the one that decides most cases: the primary duty must include the exercise of discretion and independent judgment with respect to matters of significance. Event weeks are where the overtime bill appears
A non-exempt marketing associate who works a three-day trade show will not work 40 hours that week, they will work 55 or 60, and the hours are real whether or not anyone logged them. Travel rules add to it: time spent traveling as part of the job during the work day counts as hours worked, and travel away from home that cuts across the employee's normal working hours counts even on a Saturday or Sunday. A flat event stipend does not replace overtime for a non-exempt employee, and neither does compensatory time off at a private employer.
